Effective Date: October 1, 2026
These Terms & Services (“Terms”) govern your access to the websites, marketing materials, and service request tools operated by The Ursa Group (“Company,” “we,” “us,” or “our”), as well as your enrollment in and use of any home warranty service contract (“Contract” or “Plan”) offered by the Company. By submitting an enrollment form, paying plan fees, or filing a service request, you agree to these Terms and to the specific Contract issued for your covered property.
If you do not agree, do not enroll or use our services. These Terms supplement—not replace—your Contract. Where a conflict exists, the signed Contract controls for coverage, exclusions, limits, and claim decisions.
Covered Property means the residential structure identified in your enrollment application and confirmed on your Contract schedule.
Covered Item means a system or appliance explicitly listed as covered under your Plan tier, subject to exclusions and caps.
Service Request means a claim filed by a member for diagnosis or repair of a Covered Item.
Trade Service Fee means the per-visit amount payable by the member for a dispatched contractor, as stated in the Contract.
Authorized Contractor means a technician or company assigned or approved by the Company to perform warranty work.
Plans are available for owner-occupied residences, certain investment properties, and qualifying transfers at sale, as described in your Plan documentation. You represent that information provided during enrollment is accurate, including property type, square footage, number of units, and the operational condition of systems and appliances.
Coverage does not begin until all of the following occur: (a) acceptance of your application; (b) payment of required fees; and (c) expiration of any waiting period stated in your Contract. We may decline enrollment for properties that do not meet underwriting guidelines, including those with known pre-existing failures, unsafe conditions, or incomplete inspections where required.
Plan fees may be billed monthly, annually, or on another schedule you select. Failure to pay when due may result in suspension of coverage after notice. Reinstatement may require payment of past-due amounts and confirmation that no undisclosed failures occurred during lapse periods.
Trade Service Fees are due at the time of service unless otherwise stated. Optional upgrades, code corrections, permits, or aesthetic improvements are member responsibilities unless explicitly covered.
New Contracts include a waiting period during which Service Requests are not eligible, except where prohibited by applicable law or expressly waived in writing. Renewal terms, including pricing adjustments, are communicated before your renewal date. Continued coverage after renewal constitutes acceptance of updated terms presented at renewal.
We cover mechanical or electrical failure of Covered Items caused by normal wear and tear during the Contract term, when the item was in working order at enrollment (or at transfer) and has been reasonably maintained. Coverage is limited to repair or replacement of the failed component, subject to item caps and aggregate limits in your Contract.
We do not cover cosmetic defects, noise without functional failure, inefficiency without breakdown, or damage from external events such as fire, flood, wind, theft, vandalism, or structural movement unless a separate rider applies.
Without limiting your Contract, common exclusions include:
Members must file Service Requests through approved channels before authorizing independent repairs. Unauthorized repairs may void coverage for that item. You agree to provide safe access, accurate symptom descriptions, and reasonable cooperation during diagnosis.
We will assign an Authorized Contractor within a commercially reasonable time. Scheduling depends on technician availability, weather, parts availability, and urgency. Emergency same-day service is not guaranteed unless your Plan explicitly includes priority dispatch.
We may repair with new or refurbished parts, or replace with models of like kind and quality when repair is not feasible within cost guidelines. Matching finishes, brand badges, or smart features beyond baseline equivalents may require member contribution.
If replacement exceeds item caps, you may pay the difference for a higher-tier unit or accept coverage up to the cap. Repeated failures on the same item may be limited per Contract anti-abuse provisions.
You may cancel per the cancellation section of your Contract. Refunds, if any, depend on payment timing, claims activity, and regulatory requirements. Transfers to a new owner may be available for a fee when initiated before closing and approved by the Company.
You must maintain eligible systems, replace filters, clear accessible obstructions, shut off water when leaks occur, and follow technician safety instructions. Misrepresentation, fraudulent claims, or abusive conduct may result in denial of service and termination.
Information on our website is for general education and marketing. It is not a binding offer of coverage until confirmed in a signed Contract. We may update site content without notice. Electronic communications satisfy written notice requirements where permitted.
Disputes arising from these Terms or the Contract should first be submitted to member support for informal resolution. Where required by law, you may have rights to regulatory complaint processes. Arbitration or class action waivers, if any, appear in your Contract and govern claim disputes to the extent enforceable.
To the fullest extent permitted by law, the Company is not liable for indirect, incidental, special, or consequential damages arising from site use or warranty services. Our total liability for any claim is limited to amounts paid under your Contract for the affected item or service period, except where liability cannot be limited by law.
Logos, text, graphics, and software on our properties are owned by the Company or licensors. You may not copy, scrape, or redistribute materials without written permission.
We may revise these Terms for website and general service policies. Material changes will be posted with an updated effective date. Continued use of digital services after posting constitutes acceptance for non-contractual matters.
You agree to indemnify and hold harmless the Company, its affiliates, officers, and contractors from claims arising from misuse of the website, fraudulent Service Requests, unsafe property conditions you fail to disclose, or violations of these Terms, except to the extent caused by our gross negligence or willful misconduct.
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Failure to enforce a provision does not constitute a waiver of future enforcement.
These Terms, together with applicable privacy notices and your signed Contract, constitute the entire agreement regarding use of our digital properties. Prior oral or written statements not incorporated into the Contract do not bind the Company.
Questions about these Terms or your Contract may be submitted through the Contact Us form on this website. Please include your member ID if applicable.
